The Environmental Protection Agency on May 14 sent its final rule to repeal the 2024 Carbon Pollution Standards to the White House Office of Management and Budget for interagency review. 

OBM review typically takes up to 90 days; however, EPA is likely to seek an expedited review. 

APPA said it plans to request a meeting with OMB and reiterate its support for the finalization of the alternative proposal as quickly as possible. 

APPA will also request revisions to the Phase 1 new source performance standards for intermediate- and baseload combustion turbines (CTs). 

The alternative proposal would provide relief from most of the 2024 CPS unworkable provisions. In addition, the alternative proposal does not rely on any new interpretations of the Clean Air Act.

The 2024 CPS repeal rule’s alternative proposal that would revise 40 CFR Part 60 Subpart TTTTa to remove the carbon capture and sequestration requirements for new baseload combustion turbines in Phase 2 and for coal-fired steam generating units that undergo a large modification. 

The repeal proposal would also repeal Subpart UUUUb, the emission guidelines for existing fossil fuel-fired steam generating units. However, the repeal would leave the Phase 1 new source performance standards for CTs in place.
