APPA joined a coalition in sending a letter to House and Senate leadership to “urge Congress to enact policies to modernize Section 401 of the Clean Water Act (CWA).”
The letter coincides with the Trump administration’s proposal to revise CWA Section 401 regulations, which is now under review at the Office of Management and Budget.
The letter calls for Congress to amend the CWA to limit the scope of certifications, clarify the start of the one-year certification deadline, provide regulatory certainty, ensure a timely review and decision process, prevent after-the-fact modifications, and ensure consistent federal enforcement regarding water quality certifications.
APPA noted it supports H.R. 3898, the PERMIT Act, as passed by the House Transportation & Infrastructure Committee, which would amend the CWA consistent with the principles outlined in the letter.
