Under the Public Utility Regulatory Policies Act of 1978 (PURPA), states and nonregulated electric utilities (a term that includes most public power utilities) are required to consider implementation of certain standards, although there is no requirement that the standards be adopted.  

The 2021 Infrastructure Investment and Jobs Act (IIJA) amends PURPA to add two new “must consider” provisions, relating to (1) demand response practices; and (2) electric vehicle charging programs. The IIJA requires states and nonregulated electric utilities to commence consideration of these standards no later than November 15, 2022, and this consideration must be concluded and a determination as to whether to adopt each standard made by November 15, 2023.
