Court declines to set March 1 deadline for EPA to issue final MATS rule

A federal appeals court rejected industry requests for a March 1 deadline for the Environmental Protection Agency to issue final mercury and air toxics (MATS) regulations for new coal-fired generating units. The agency is reconsidering provisions in its MATS rule regarding new units and expects to complete that some time in March. "To the extent the request for a rulemaking deadline is based on a claim of future delay in issuing a final rule, it is unripe for adjudication at this time," the U.S. Court of Appeals for the District of Columbia Circuit said in its order denying the request in White Stallion Energy Center v EPA.
